By using OSBC Online, you agree, pursuant to K.S.A. 45-220(c)(2) of the Kansas Open Records Act, that you do not intend to and you will not:

(A) Use any list of names or addresses contained in or derived from the records or information for the purpose of selling or offering for sale any property or service to any person listed or to any person who resides at any address listed; or

(B) Sell, give, or otherwise make available to any person any list of names or addresses contained in or derived from the records or information for the purpose of allowing that person to sell or offer for sale any property or service to any person listed or to any person who resides at any address listed.

I understand that use of the information in contravention of state law is prohibited and carries civil penalties of up to $500 per violation.

About the Application Process

Certain activities require approval from the Commissioner or the Kansas State Banking Board prior to banks and trust companies proceeding with a transaction. Kansas banking statutes and regulations outline the required application procedures, as well as the information to be included and the criteria used to make the decision. Applications are reviewed to assess compliance with applicable statutes and regulations; the affect the proposed transaction will have on the operation and condition of the institution; and how the transaction will affect Kansas consumers. The time frame required to process an application is dependent on the type and complexity of the transaction. Additionally, a filing fee is required for most applications per K.S.A. 9-1726, and can be found within each application form provided below. Public notification of certain applications is required via local area newspapers, and links to sample publication outlines are available below.

All applications, subject to limitations imposed by federal or state statutes, are available to members of the public. The Kansas Open Records Act (K.S.A. 45-215 et seq.) exempts from public disclosure “records the disclosure of which is specifically prohibited or restricted by federal law, state statute or rule of the Kansas Supreme Court…” Information exempt from public disclosure under the Freedom of Information Act (5 U.S.C. 552) is also exempt from disclosure under the Kansas Open Records Act. Information for which confidential treatment is requested should be separately bound and labeled “Confidential.”

New Charter

The following forms should be used for applications to establish a de novo banking business or de novo trust business.

Conversion to a Kansas State Charter

The following form should be used for an existing financial institution to convert to a Kansas State Charter.

New Branch or Relocation

The following form should be used for the following applications:

  • New Branch, In State
  • New Branch, Out of State
  • Relocate an Existing Branch
  • Relocate a Main Office
  • Relocate a Main Office and Retain Existing Office as a Branch
  • Interchange of Main Office and Branch Office

Bank/Trust Company Merger

A link to the Interagency Bank Merger Act Application can be obtained from the Federal Deposit Insurance Corporation website. In addition to this merger application, the Office of the State Bank Commissioner requires that certain supplemental information be provided.

Change of Control

Information regarding state procedures for bank changes of control is provided below.  A copy of the application form submitted to Federal regulators should also be submitted to the OSBC.

The following form should be used for the following applications:

  • Relocate an Existing Trust Service Office
